Introduction
Welcome to Adventrix Travel. These Terms of Service ("Terms") govern your access to and use of our website, platform, and services. By accessing or using Adventrix, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, joining our waitlist, or booking any travel experience through Adventrix Travel ("Adventrix," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not use our services.
2. Eligibility
You must be at least 18 years old to use our services. By using Adventrix, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. For travelers under 18, a parent or legal guardian must complete the booking and assume all responsibilities under these Terms.
3. User Accounts
3.1 Account Registration
To access certain features, you must create an account providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3.2 Identity Verification
Adventrix employs identity verification procedures to ensure traveler safety and authenticity. You agree to provide government-issued identification and other verification documents as requested. Failure to complete verification may result in booking cancellation without refund.
3.3 Account Suspension
We reserve the right to suspend or terminate your account if you violate these Terms, provide false information, engage in fraudulent activity, or behave inappropriately toward other community members.
4. Waitlist Registration
4.1 Non-Binding Registration
Joining our waitlist does not constitute a binding commitment to book or purchase any travel services. Waitlist registration is free and serves to express interest in future Adventrix offerings.
4.2 Priority Access
Waitlist members may receive priority access to booking opportunities, exclusive offers, and early-bird pricing. Priority is generally granted based on registration date, though we reserve the right to modify priority criteria.
4.3 Communications
By joining the waitlist, you consent to receive email communications about our launch, trips, platform updates, and special offers. You may unsubscribe at any time using the link provided in our emails.
5. Travel Bookings
5.1 Booking Process
All travel bookings are subject to availability and confirmation. A booking becomes binding only upon our written confirmation and receipt of the required deposit or full payment. We reserve the right to refuse any booking at our discretion.
5.2 Pricing and Payment
All prices are listed in Euros (EUR) or US Dollars (USD) as indicated and are subject to change until booking confirmation. Prices include specified services only; additional costs such as international flights, travel insurance, visa fees, and personal expenses are not included unless explicitly stated. Payment schedules, including deposit amounts and final payment deadlines, will be specified in your booking confirmation.
5.3 Deposits and Final Payment
Two types of deposits apply: (a) Selection Deposit ($99 USD): A refundable deposit required to enter the traveler matching process. This deposit is 100% refundable if a compatible Tribe is not found. If matched, the $99 is credited toward the total trip price. (b) Trip Balance: Once matched and confirmed, the remaining trip balance is due 60 days before departure. Failure to complete final payment by the deadline may result in booking cancellation and forfeiture of matching eligibility.
6. Cancellations and Refunds
6.1 Cancellation by Traveler
Cancellation policies vary by trip and are detailed in your booking confirmation. Generally: (a) Cancellations more than 90 days before departure: deposit forfeited, remaining balance refunded; (b) Cancellations 60-89 days before departure: 50% of total trip cost forfeited; (c) Cancellations 30-59 days before departure: 75% of total trip cost forfeited; (d) Cancellations less than 30 days before departure: 100% of trip cost forfeited (no refund). All cancellations must be submitted in writing via email to contact@adventrix.travel.
6.2 Cancellation by Adventrix
We reserve the right to cancel any trip due to insufficient enrollment, force majeure events, safety concerns, or other circumstances beyond our control. If we cancel your trip, you will receive a full refund of all payments made, or the option to transfer to an alternative trip. We are not liable for any additional costs incurred (flights, visas, etc.) in such circumstances.
6.3 Trip Modifications
We reserve the right to modify trip itineraries, accommodations, activities, or other aspects due to weather, safety concerns, permit changes, or unforeseen circumstances. We will make reasonable efforts to provide comparable alternatives. No refunds are provided for minor itinerary modifications.
7. Travel Insurance
We strongly recommend comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and lost baggage. Adventrix is not responsible for costs arising from cancellations, medical issues, or other incidents that would be covered by travel insurance. Proof of travel insurance may be required before departure.
8. AI Compatibility Matching
8.1 Matching Technology
Our AI-powered matching system analyzes traveler profiles, preferences, and compatibility factors to create harmonious group compositions. While we strive for optimal matches, we cannot guarantee specific outcomes or interpersonal chemistry. Final group composition is at Adventrix's discretion.
8.2 Profile Accuracy
Accurate matching depends on honest, complete profile information. You agree to provide truthful responses to all matching questions and update your profile if your circumstances or preferences change. Providing false information may result in account suspension.
8.3 No Guarantees
While our matching technology is sophisticated, we cannot guarantee that you will form friendships or enjoy the company of all group members. Interpersonal relationships depend on many factors beyond our matching criteria.
9. Traveler Conduct and Community Guidelines
9.1 Expected Behavior
All travelers must treat fellow participants, guides, staff, and local communities with respect and courtesy. Harassment, discrimination, violence, or inappropriate behavior of any kind will not be tolerated and may result in immediate removal from the trip without refund.
9.2 Safety Compliance
You must follow all safety instructions provided by guides and staff. Adventrix reserves the right to exclude any traveler from activities if their behavior poses safety risks to themselves or others.
9.3 Local Laws and Customs
You are responsible for understanding and complying with local laws, customs, and regulations in all destinations visited. Adventrix is not responsible for legal consequences arising from your violations of local laws.
10. Health and Fitness Requirements
10.1 Medical Disclosure
You must disclose all relevant medical conditions, medications, allergies, and physical limitations that may affect your ability to participate safely in trip activities. Failure to disclose material health information may void your booking and result in removal from the trip without refund.
10.2 Physical Fitness
Each trip specifies minimum fitness and activity levels required. You warrant that you meet these requirements and can safely participate in all listed activities. We may request medical clearance certificates for certain trips.
10.3 High Altitude Travel
Some of our trips may involve high altitude destinations (above 3,000 meters / 10,000 feet). You acknowledge the risks of altitude sickness and accept responsibility for any health issues arising from high altitude exposure. Consult your physician before booking high altitude trips.
11. Limitation of Liability and Assumption of Risk
11.1 Assumption of Risk
Adventure travel inherently involves risks including injury, illness, property damage, or death. By booking with Adventrix, you acknowledge and voluntarily assume all risks associated with your participation, including but not limited to: transportation accidents, natural disasters, altitude sickness, extreme weather, wildlife encounters, equipment failure, and political instability.
11.2 Limitation of Liability
To the maximum extent permitted by law, Adventrix's total liability for any claims arising from your trip is limited to the amount you paid for the trip. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.
11.3 Third-Party Services
Adventrix acts as an intermediary for third-party service providers including airlines, hotels, ground transportation, activity operators, and restaurants. We are not liable for acts, errors, omissions, or negligence of these third-party providers. Claims arising from third-party services must be directed to the respective provider.
11.4 Force Majeure
Adventrix is not liable for failure to perform obligations due to circumstances beyond our reasonable control, including: acts of God, war, terrorism, civil unrest, government restrictions, natural disasters, pandemics, strikes, or other force majeure events.
12. Intellectual Property
12.1 Platform Content
All content on the Adventrix platform, including text, graphics, logos, images, software, and trademarks, is owned by Adventrix or our licensors and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.
12.2 User-Generated Content
By submitting photos, reviews, testimonials, or other content to Adventrix, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for marketing, promotional, and operational purposes. You warrant that you own all rights to submitted content.
12.3 Photography and Video
During trips, Adventrix and our partners may capture photos and videos that include you. By participating, you consent to the use of your likeness in our marketing materials, website, and social media. You may opt out by notifying us in writing before the trip.
13. Privacy and Data Protection
Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Adventrix, you consent to our data practices as described in the Privacy Policy. We comply with applicable data protection laws, including GDPR for EU residents.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by the laws of Argentina, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Adventrix shall be subject to the exclusive jurisdiction of the courts of Buenos Aires, Argentina.
14.2 Arbitration
For disputes involving amounts under USD $10,000, you agree to resolve the dispute through binding arbitration in Buenos Aires, Argentina, under the rules of the Buenos Aires Arbitration and Mediation Center. The arbitrator's decision is final and binding.
14.3 Class Action Waiver
You agree to resolve disputes with Adventrix on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration against Adventrix.
15. Amendments to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent website notice. Continued use of our services after changes constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely achieves the original intent.
17. Entire Agreement
These Terms, together with our Privacy Policy and any trip-specific terms in your booking confirmation, constitute the entire agreement between you and Adventrix regarding your use of our services. These Terms supersede any prior agreements or understandings.
